Criminal Penalties for Indecent Exposure

Being convicted of indecent exposure is a serious event. According to Section 21.08 of Texas Penal Code, a person commits an act of indecent exposure if they expose any part of their anus or genitals with the intent to arouse or gratify the sexual desire of any person. The law continues to read that the exposure is “indecent” if it is committed with reckless disregard for who may witness the exposure.

Under the same section of Texas’ penal code, the offense is classified as a Class B misdemeanor.

A Class B misdemeanor, per Section 12.22 of Texas Penal Code, is punishable by a fine of up to $2,000, a jail term of not more than 180 days, or both. If convicted of indecent exposure, the defendant may also be required to register as a sex offender. Registering as a sex offender can be limiting and embarrassing, and may prohibit the individual from living in certain areas, gaining custody of their child in the future, gaining employment, and more. Further, a mark on one’s criminal record may be permanent; if convicted of a sex crime, you may never have the same opportunities that you do now, and your relationships with your family and your employer(s) may be damaged.

In some cases, a person commits an act of indecent exposure with intent, and sometimes, the offense may be accompanied by another sex crime.
