Criminal Penalties for Incest

Per Section 25.02 of Texas Penal Code, the act of sexual intercourse or deviate sexual intercourse (defined as contact between the genitals of one person and the mouth or anus of another person) are prohibited between an individual and their:

  • Ancestor or descendant by blood or adoption;
  • Stepchild or stepparent;
  • Parent’s brother or sister (the individual’s aunt or uncle);
  • Brother or sister (whole, half, or by adoption);
  • Cousins; or
  • Nieces or nephews.

According to Texas Penal Code, committing sexual intercourse with one of the above parties is punishable as a third degree felony. However, if the act of incest is committed with one’s ancestor or descendant by blood or adoption (i.e child, grandchild, etc.), then the crime is classified as a second degree felony.

A second degree felony is punishable by no less than two years in prison but no more than 20, and a fine of up to $10,000; a third degree felony is punishable by a prison term of not less than two years and not more than 10, as well as a fine of not more than $10,000. Keep in mind that if the crime involves a child, further criminal charges may be assessed as well. A subsequent criminal charge may also be assessed if the incest is not voluntary.
