Criminal Penalties for Fondling
It is important to note that Texas Penal Code does not specifically address “fondling” as a sexual crime; rather, the law alludes to fondling in its description of other sexual crimes, including: public lewdness, indecency with a child, and improper relationship between educator and student.
The first crime, public lewdness, prohibits “an act of sexual contact” that may offend or alarm another, and that is committed in a public place; indecency with a child prohibits sexual contact or attempt to engage in sexual contact with a child; and improper relationship between educator and student prohibits sexual contact of any type between an educator and their student.
Section 21.01(2) of Texas Penal Code defines sexual contact as “any touching of a person, including touching through clothing, of the anus, breast, or any part of the genitals…” of either a child or of any person with the intent to arouse or gratify the sexual desire of any person. Per this definition then, “fondling” and “sexual contact” may be synonymous.
Public lewdness is as a Class A misdemeanor; indecency with a child is a second degree felony; and improper relationship between educator and student is a second degree felony. A Class A misdemeanor is punishable by a fine of up to $4,000, jail time of up to one year, or both. A second degree felony is more harshly punished, and is penalized by a prison sentence of not more than 20 years and not less than two, as well as a fine of up to $10,000.
